Minutes of the regular meeting of the Brant Town Board held on Tuesday May 9th, 2006 at 7:30 PM at the Brant Town Hall, at 1294 Brant-North Collins Rd, Brant, New York. with two public hearings; one at 8:00 P.M. Local Time for the purpose of considering the adoption of Proposed Local Law No. 2 of 2006, which would eliminate current Section 25-3 of the Town of Brant Code which requires the posting and publishing of adopted local laws, and the second one at 8:15 P.M. Local Time for the purpose of considering the adoption of Proposed Local Law No. 3 of 2006, which would impose residency restrictions on convicted, registered sex offenders in the Town of Brant.

There was some discussion about the permits that the town does not have a fee set for such as: swimming pools, chimneys and demolition. Gary Brecker’s suggestion was to set fees for those items and not raise the already set amounts on other permits.

1) Police Chief Update:
Supervisor Pero read from a letter received from Chief David Hock naming new police officers to fill the roster and to sponsor a candidate for training. Chief Hock spoke on his progress in updating the computers, radios and patrolling. Supervisor Pero shared with the audience that Chief Hock will be driving the police car to his home and that insurance was verified for Officer Ambo.

Supervisor Pero read the roster of police officers: Michael Green, Ernest Masullo, John Giacchino, Samuel Pinto, Ronald Raczka, Raymond Zabron, Michael Felschow, & Richard Lopez. Amanda Kuhls is an academy enrollee and there will be no monetary compensation for hours.
2) Memorial Park Streetscape update
On Thursday May 4th at their workshop the Board had an public meeting for suggestions and concerns for the work to be done at Memorial Park. Ideas were shared, the town needs to get another set of designs based on public comment and change the order request and the board needs to get two (2) additional quotes for design & bid specifications other than E & M Engineers.
3) Water District #1 & Surfside
The Water Committee members are meeting May 10 with Erie County Water Authority and will have more information on the whole water district.
A class is being held May 10th at North Collins at 6:00 PM till 10 PM.
Meeting with Dave Mascio on May 11th at 7:00 PM and previously the board met with Joe Giambrone.

Pursuant to a resolution of the Town Board of the Town of Brant, New York, NOTICE IS HEREBY GIVEN of the following PUBLIC HEARINGS to be held by the Brant Town Board in the Town Hall, 1294 Brant-North Collins Road, Brant, New York on the 9th day of May, 2006: At 8:00 P.M. ADOPTED: TOWN OF BRANT LOCAL LAW NO. 2 OF THE YEAR 2006
A local law amending Chapter 25 of the Town of Brant Code to eliminate the requirement of publishing and posting adopted local laws.
Be it enacted by the Town Board of the Town of Brant as follows:
WHEREAS, Chapter 25 of the Town of Brant Town Code, adopted in 1967, requires adopted local laws to be published and posted after their adoption, and
WHEREAS, the publishing and posting of adopted local laws is not mandated by state law and results in unnecessary additional cost and administrative time.
NOW, THEREFORE, the Town Board of the Town of Brant hereby adopts the following changes to Chapter 25 of the Town of Brant Code:
Section 25-3, entitled “Publication and Posting upon Adoption” is hereby deleted in its entirety.
Section 25-4, entitled “Proof of Publication and Posting” is hereby re-numbered as “Section 25-3" and is modified to read as follows: Proof of publication of the notice of public hearing required by Section 25-1 hereof shall be filed in the office of the Town Clerk.”
Section 25-5, entitled “Numbering” is hereby re-numbered as “Section 25-4.”
This local law shall take effect upon filing in the office of the Secretary of State.
6) Dry Hydrant
The Town Park pond is used by the Fire Departments for drafting and the unit needs to be adapted for size and use. Supervisor Pero asked for authorization to sign the lowest bid to complete the job which some figures estimated to be about $800.00 to $1,000.00 completed.

Supervisor Pero reported that the Boy Scouts have started on Brant Reservation Rd., sweeping and cutting into the old sidewalks. Pero would like to see a committee formed for sidewalks.

Supervisor Pero reported that in August we should know if we have a grant for the park- playground, filed for a court grant, and a NY Preservation grant.

ADOPTED: TOWN OF BRANT LOCAL LAW NO. 3 OF THE YEAR 2006: A LOCAL LAW ENACTING RESIDENCY RESTRICTIONS ON SEX OFFENDERS. BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF BRANT AS FOLLOWS:
Be it enacted by the Town Board of the Town of Brant as follows:
Section 1: Sex Offender Residency Restriction
A. Legislative Intent
The adoption of Megan’s Law has increased public awareness of sexual offenders by requiring them to become registered with authorities and making such information available to the public. New York State has not adopted uniform, statewide standards regulating the residency of registered sex offenders in proximity to public places frequented by persons most vulnerable as possible targets of sex offenders, thus leaving it to local governments to adopt such regulations. The Town Board of the Town of Brant believes this legislation is necessary to further protect the best interests of all children, and to protect the health, safety and welfare of residents in the Town of Brant.
B. Definitions
As used in this law, the following terms shall have the meanings indicated:
TEEN/COMMUNITY CENTER-any building/structure where persons under the age of eighteen (18) years are invited and congregate for the purpose of social activity, education, athletics and/or entertainment.
No person over the age of eighteen (18) years, who has been convicted of a violation of a sexual offense upon a child of the age of sixteen (16) years or under, as defined by the New York State Penal Law, which would require that individual to register as a sex offender under state and/or federal laws, shall be permitted to reside or live within one thousand five hundred (1,500) feet, measured as the shortest distance from property line to property line of the real property of any:
1. School
2. Park
3. Playground
4. Day Care Center
5. Teen/Community Center, or
6. Church which operates any child or youth-centered program
in the Town of Brant, unless such residence has been assigned by a supervised release program, which provides close supervision of the sex offender’s daily activity, or the residency of said offender was established prior to the enactment of this legislation.
D. Penalties
Failure to comply with this section shall be considered a violation punishable by a fine not to exceed One Thousand Five Hundred Dollars ($1,500.00) or imprisonment not to exceed fifteen (15) days, or both.
E. Severability
If any clause, paragraph, section or part of this chapter shall be adjudicated by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder thereof but shall be continued in its operation to the clause, sentence, paragraph, section or part thereof directly involved in the controversy in which such judgment shall have been rendered.
Section 2: Effective Date
This local law shall take effect upon filing with the Secretary of State.

1) Junkyard Review 2) Noise – Nuisance Ordinance
There were three new laws – noise, nuisance and junk drawn up for the planning board, board and code officer to review for final draft and then there will be a public hearing, reported by Supervisor Pero.

4) Memorial Day
Supervisor Pero announced that Memorial Day Services would be held at 9:00 AM on Monday May 29th at the Memorial Park and 10:30 at the Farnham Village Hall with a concert and a Barbeque at noon.
5) Preserve NY
Supervisor Pero informed the public that a grant has been filed for a survey of historical landmarks and buildings in Brant. The final report will give the town recommendations and documentation for our historical resources. The grant would provide $ 8,640.00 and the towns share would be $2,880.00 if approved.
6) ZBA Alternate

WHEREAS, the New York State Thruway Authority (NYSTA) is a public benefit corporation organized under the laws of the State of New York, whose three commissioners are appointed under the Governor, and
WHEREAS, in the immediate Buffalo area the NYSTA maintains toll barriers at the Williamsville, Depew, Lackawanna, Blasdell, Hamburg, Ogden Street/Buffalo City Line, Black Rock, both the North and South Grand Island Bridges and Eden Evans Exit 57A, and
WHEREAS, these before mentioned toll barriers act as a commuter tax on persons residing in the Buffalo area and are an added tax on commerce in the Buffalo Metropolitan area which has not only immediate monetary ramifications for intrastate and interstate travel into and out of the various areas of Western New York but also causes undue delay to commercial traffic which has an adverse impact upon operational and financial aspects of commerce, and
WHEREAS, if the NYSTA and the Governor are not inclined to eliminate these toll barriers because of some misguided idea that commuters in the Buffalo area should have to pay for these highways then they should at least recognize the detrimental impact these toll barriers pose to intrastate and interstate commerce which by slowing down commercial traffic causes undue delay in the shipment of goods, increases the amount of fuel consumed, adversely affects the air quality in the Buffalo area, and, is viewed as one more “hidden tax” which can negatively impact the way the Buffalo area and the State of New York are viewed by out of area businesses which might otherwise choose to locate here, and
WHEREAS, the Western New York area shares an extremely busy front point with commerce moving to and from the Province of Ontario, Canada and it being critical to assist in the movement of commerce between our two nations and for the State of New York to fulfill its role in improving the flow of commerce which can have a defined positive impact on the economy of the Niagara Frontier, and
WHEREAS, the Town Board of the Town of Brant desires to make public its opposition to the continuation of tolls at the Williamsville , Depew, Lackawanna, Blasdell, Hamburg, Ogden Street/Buffalo City Line, Black Rock, both the North and South Grand Island Bridges and Eden-Evans Exit 57A, and
NOW, THEREFORE, BE IT
RESOLVED, That the Town Board of the Town of Brant hereby memorializes the Governor and the Commissioners of the New York State Thruway Authority to remove the toll barriers at Williamsville, Depew, Lackawanna, Blasdell, Hamburg, Ogden Street/Buffalo City Line , Black Rock, both the North and South Grand Island Bridges and Eden-Evans Exit 57A which removal will afford the easier passage of commerce and commuters through the Western New York area which in turn will be beneficial to the economy of Western New York and New York State as a whole, and BE IT FURTHER

Supervisor Pero informed those present that Brant Auto will pick up junk cars, etc. Future possible refrigerator pick up also.
9) Trash Regulations
After several complaints of garbage being put out all week and not picking up cans etc. Supervisor Pero read the following town guidelines for refuse pick up: All materials shall be place in a neat and orderly fashion within four (4) feet of the curb. Items must be place at the curbside by 6:30 Am the day of collection, but no sooner than 24 hours before. Friday is pick up day with the exception of the following holidays: New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, Christmas.
10) Recreation

There is a hazardous waste drop off at ECC North Campus on May 13, there is a flyer in the Town Hall.
2) Adelphia
There is a list of regent’s reviews for exams which is available on cable the schedule is available at the Town Clerks office.
3) Rural Transit
There is a need for volunteers for our local Rural Transit Organization - flyers will be posted.
4) Mrs. New York
WHEREAS, Jennifer Daniel Stehlar was born and raised in the Town of Brant until she got married in 2002 and is on the Board of Directors of “Headway for Brain Injured Inc.”
WHEREAS, on May 6, 2006 at the age of 26, She competed under the title of Mrs. Erie County with a platform of “Brain Injury Awareness & Prevention” against other women from all over New York State.
WHEREAS, The citizens of the Town of Brant recognize Her outstanding Achievement as being crowned Mrs. New York State and is one of Our own.
WHEREAS, The entire town wishes Her Good Luck as She competes in Las Vegas, Nevada for the National Crown of Mrs. United States of America on July 26 & 27, 2006.
WE THEREFORE PROCLAIM, By order of the Brant Town Board
That the Month of May in the year 2006 be recognized as:
JENNIFER DANIEL STEHLAR MONTH.
Jennifer spoke to the Board and those present about her personal experiences which resulted in her involvement in Brain Injury Awareness. Jennifer stated that she is honored to be the recipient of such a proclamation, and that she was looking forward to the Brant Summer Fest.

Supervisor Pero opened the ACKNOWLEDGEMENT OF VISITORS if anyone present had any questions or concerns.
Lee Brunelli mentioned to the Board that there is a service in Evans which is called Park & Ride.
Martin Rosiek commented to the recreation committee members that the lifeguards should be hired ASAP as they are in high demand. Rosiek asked for clarification that the land acquisition is contingent on the town receiving grant monies.
